Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Sourcewise Investments Ltd (Company No. 15334663, registered in England and Wales) regarding your use of the Stillglow mobile application ("the App") and the website at www.sourcewiseinvestmentsltd.com ("the Website").

By downloading, installing, or using the App, or by accessing the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App or Website.

You must be at least 13 years of age (or 16 in certain jurisdictions) to use the App. By using the App, you represent that you meet this age requirement.

To access the core features of Stillglow, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used in a manner that could harm other users or the App.

You may delete your account at any time through the App's settings or by contacting us. See our Privacy Policy — Data Deletion section for details.

Subscription plans

Stillglow may offer free and paid subscription tiers. Paid subscriptions provide access to additional features as described in the App at the time of purchase. Subscription features and pricing are subject to change with reasonable notice.

Billing

For iOS users, all subscriptions and in-app purchases are processed through Apple's in-app purchase system and are subject to Apple's payment terms. Payments are charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Cancellation

You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.

Refunds

All refund requests for iOS in-app purchases must be submitted directly to Apple in accordance with Apple's refund policy. Sourcewise Investments Ltd does not process refunds for purchases made through Apple's in-app purchase system. For other billing enquiries, contact us at [email protected].

Free trials

Where a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled before the trial ends.

Stillglow allows you to upload, record, and store personal content including voice recordings, photographs, written memories, and other media ("Your Content"). You retain full ownership of Your Content.

By uploading or creating content within the App, you grant Sourcewise Investments Ltd a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the App's functionality to you. This licence ends when you delete the content or your account.

You are solely responsible for Your Content and represent that: (a) you own or have the necessary rights to upload it; (b) it does not infringe any third-party intellectual property rights; and (c) it does not violate any applicable law.

We do not use Your Content for advertising, AI training, or any purpose beyond delivering the App's features to you. See our Privacy Policy for full details on how we handle voice recordings and media.

You agree to use the App and Website only for lawful purposes and in accordance with these Terms. You must not:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Infringe the intellectual property rights of any third party
• Attempt to gain unauthorised access to any part of the App, its servers, or any connected systems
• Use the App to transmit unsolicited communications or spam
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated tools, bots, or scrapers to access or extract data from the App
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the App in any way that could damage, disable, or impair its operation

We reserve the right to remove any content and suspend or terminate any account that violates these acceptable use standards, without prior notice.

The Stillglow App, the Sourcewise Investments Ltd website, and all associated content — including but not limited to the name "Stillglow", logos, design, software, text, graphics, and audio — are the exclusive property of Sourcewise Investments Ltd and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the App or Website beyond the limited licence to use the App as described herein. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the App or Website without our express written permission.

The Stillglow App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Sourcewise Investments Ltd makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that any defects will be corrected.

Stillglow is a digital memorial and emotional wellbeing platform. It is not a substitute for professional mental health support, grief counselling, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

To the fullest extent permitted by applicable law, Sourcewise Investments Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App or Website, including but not limited to loss of data, loss of profits, or emotional distress.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or £50 (whichever is greater).

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or if required to do so by law.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending a notification through the App or by email. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in another jurisdiction, you may also have rights under the laws of your local jurisdiction that cannot be excluded by this clause.
